Terms and Conditions for Aapi Digital Solutions

Welcome to Aapi Digital Solutions. These Terms and Conditions outline the rules and regulations for using our services. By accessing or using our services, you agree to comply with these terms. If you disagree with any part of these terms, please do not use our services.
1. Definitions

1.2 “Client” refers to any individual, organization, or entity purchasing or using our services.
1.3 “Services” include Website Development, Digital Marketing, and Search Engine Optimization (SEO), as well as other offerings provided by the Company.
2. Scope of Services
2.1 The Company provides services as outlined in the agreed-upon proposal or contract.
2.2 Any additional services requested by the Client will require a separate agreement and additional fees.
2.3 The Company reserves the right to decline or terminate services if the Client violates any terms of this agreement.
3. Client Responsibilities
3.1 The Client must provide accurate and timely information necessary for the completion of the services.
3.2 The Client is responsible for reviewing deliverables and providing feedback within the specified timelines.
3.3 The Client must ensure that all content, materials, and data shared with the Company comply with applicable laws and do not infringe on third-party rights.
4. Payments
4.1 The Client agrees to pay all fees as outlined in the proposal or invoice.
4.2 Payments are non-refundable unless otherwise agreed in writing.
4.3 Late payments may result in the suspension or termination of services.
4.4 Any applicable taxes will be added to the fees and are the Client’s responsibility.
5. Intellectual Property
5.1 The Company retains ownership of all intellectual property rights in materials, tools, and processes used to deliver the services unless explicitly transferred in writing.
5.2 Upon full payment, the Client will own the final deliverables created for their specific use, excluding reusable templates, code, or tools.
5.3 The Client agrees not to resell or redistribute any deliverables without prior written consent from the Company.
6. Confidentiality
6.1 Both parties agree to maintain the confidentiality of proprietary information shared during the course of the project.
6.2 The Company may use project details, excluding sensitive information, for portfolio or marketing purposes unless expressly prohibited by the Client.
7. Limitation of Liability
7.1 The Company is not liable for any indirect, incidental, or consequential damages resulting from the use or inability to use the services.
7.2 The Company’s liability is limited to the amount paid by the Client for the specific service that caused the dispute.
8. Termination
8.1 Either party may terminate the agreement with 14 days’ written notice.
8.2 Upon termination, the Client will pay for all completed work and reimbursable expenses up to the date of termination.
9. Dispute Resolution
9.1 Any disputes will be resolved amicably through negotiation.
9.2 If the dispute cannot be resolved, it will be submitted to binding arbitration under the laws of Pakistan.
10. Modifications to Terms
10.1 The Company reserves the right to update or modify these Terms and Conditions at any time.
10.2 Continued use of the services after any changes constitutes acceptance of the revised terms.
11. Governing Law
11.1 These Terms and Conditions are governed by the laws of Pakistan.
11.2 Any legal action will be conducted within the courts of Pakistan.
12. Free Website Offer
12.1 The free website offer is a limited-time promotion and may be discontinued or canceled by the Company at any time without prior notice.
12.2 The free website offer is applicable only for websites with a maximum of 5 pages.
12.3 The Company does not provide content for the free website. Clients must supply all content, including text and images. Content writing services can be provided for an additional fee.
12.4 To be eligible for the free website offer, the Client must purchase hosting through the Company’s affiliate link.
12.5 The Client will choose a website template from the options provided by the Company. Templates are pre-designed, and the Client cannot request custom designs or submit their own designs for implementation.
12.6 Any additional customizations or requirements outside the scope of the offer may incur extra charges as determined by the Company.
